Negotiating the Oil and Gas Lease: The oil and gas lease is the primary document a mineral owner will be asked to sign by an oil and gas exploration company. The important elements from a royalty owner’s point of view are: Lease bonus, how much money is offered per acre; primary term, how long will the lease be in force before the lease expires and a new lease bonus must be paid; yearly lease payments or is the lease paid up; and royalty measured in percentage of production, i.e., 1/8th royalty, 3/16th, 1/4th or royalty measured in the decimal point system where the fractions are converted to decimals.
